- Uninsured Motorist Coverage: Even if you believe you did not purchase UIM coverage, Florida law may require your insurance company to provide UIM coverage if the company failed to meet certain legal requirements.
- Insurance Coverage Exclusion: Oftentimes, an insurance company will try to enforce a specific exclusion in the policy to deny a claim. For example, many homeowners' insurance policies exclude damage caused by mold, wet rot or dry rot. If someone is injured after slipping on a wet floor, and the floor is wet because of mold damage, the insurance company will attempt to deny the claim. I spend a lot of time thoroughly reviewing the relevant insurance policies to make sure my clients' claims are not being improperly denied.
- Improper Insurance Policy Cancellations: In some cases, the insurance company will refuse to pay on a claim because the policy was cancelled before the incident occurred. The company may claim the policy was cancelled due to nonpayment or because the policyholder misrepresented important information on the application. If the insurance company's reason for cancelling the policy is invalid, the policy must be honored.
